Standard Terms & Conditions

Below is an outline of our standard terms and conditions. Please take time to read through thoroughly and ensure you understand these terms and conditions before you commence a project with Hynd Design.


Quote Acceptance

"The Client" agrees to provide written approval or emailed approval of the quote before any work is commenced. All quotes are valid for thirty (30) days from date of issue.


Quote Deposit

"The Client" agrees to pay a non-refundable 50% deposit of the quoted amount to commence any project, with the balance payable prior to delivery.


Invoices

"The Client" agrees to pay the invoiced amount within fourteen (14) days of receipt of an invoice. Failure to pay within the stated time frame may result in a late fee being applied to there account. Payment details will appear on invoice sent to "The Client".


Excess Work

This is defined as any work involving additions to the list of items defined in the quote or changes to all pieces of finished artwork after sign off by an authorised representative of "The Client".


Approval Of Final Artwork

"The Client" to proof read and approve all final copy before the production of artwork. The email verification of the Client's Representative shall be conclusive as to the approval of all artwork prior to their release for printing, implementation or installation. While Hynd Design takes all care to avoid errors, "Hynd Design" accepts no responsibility for typographical errors, spelling mistakes, or incorrect information on any project approved by a client. No refunds or reprints are given after a final approved design has gone to print due to oversights by "The Client's" proof reading.


Colour Variations

With all printing there may be some colour variations from what you have seen on screen, to what the final product looks like, and previous orders. This is due to the nature of CMYK printing and bulk-run printing system. There will be no reprints at our expense.

Website Quote Acceptance

Website Payment Terms

Because there is a lot of work involved in developing a website, we require progressive payment to help us provide you with the best possible service. Below is our website payment terms:

- 50% non-refundable deposit, on acceptance of quote

- Final 50% payment due before site goes live, or if we wait for more than two months (60 days from quote acceptance) for feedback at any time your website is deemed finished and the balance is due and payable.


Web Starter Package Terms & Conditions


Web Starter Package Websites

All Web Starter Package Websites are built in standards-compliant HTML/XHTML using CSS and Javascript as required by the design. Every Web Starter Package website, comes with one (1) Contact form. The form will be submitted to one (1) email address, nominated by "The Client". All content and images must be supplied by "The Client" in electronic format. Any content or images that are not supplied electronically, will incur additional charges and will be invoiced to "The Client" separately.


Web Starter Package Hosting

- Hynd Design utilises a third party hosting provider. "The Client" may occupy the total amount of 1GB of disk space and utilize no more than 10GB of data transfer (Data transfer is counted for both inbound and outbound data). Additional fees will be charged for exceeding the disk space and/or network bandwidth allowance of this plan. All additional fees will be invoiced to "The Client" as a separate item.


- "The Client" is allowed unlimited POP3 email accounts (Email quota you setup is allocated from your disk space). Fair use policy applies.


- Hosting is included for the first twelve (12) months, from date of acceptance of quote. "The Client" agrees to pay ongoing hosting after this period has ended. Hynd Design will provide a invoice for this renewal. Failure to renew your website hosting may result in your website going 'offline' and your e-mail facility not working. A charge may be levied to reinstate your website and e-mail services.


Web Starter Package Domain Name

- Hynd Design utilises a third party domain name provider. Domain Name Registrations are for the period of: .au - 2 Years, .com/.net/.org - 1 Year. Domain names are subject to availability and as per policy of the respective Domain Name Authority .The client agrees to accurately provide all details to the best of their knowledge to assist with the application.


- Domain Name Registration is included for the following period from date of acceptance of quote: .au - 2 years, .com/.net/.org - 1 year. "The Client" agrees to pay ongoing domain name registration charges after this period has ended. Hynd Design will provide a invoice for this renewal. Failure to renew your domain name may result in your website going 'offline' and your e-mail facility not working. A charge may be levied to reinstate your website and e-mail services.

Copyright

- "The Client" shall not submit for use by Hynd Design anything whose use would constitute an unauthorised dealing with copyright material. In the event of any breach of this condition resulting in such an unauthorised dealing, "The Client" shall remain liable to pay all sums due to Hynd Design under the relevant contract and shall further indemnify Hynd Design against any loss, costs or expenses attributable to such unauthorised dealing.


- Until final payment, Hynd Design retains full ownership of all artwork and website architecture. Hynd Design reserve the rights to certain elements used to create your images including fonts, patterns, stock images, textures, colour palettes and other non exclusive items.


Privacy

Your privacy is important to us. This privacy statement provides information about the personal information that Hynd Design collects, and the ways in which we use that personal information.


We may collect and use the following kinds of personal information:


- Information about your use of this website
- Information that you send to Hynd Design


Liability

The parties agree that in no event shall Hynd Design be liable to any third party for "The Client's" breach or alleged breach of any of the terms and conditions set forth in this Agreement. "The Client" agrees to defend, indemnify and hold harmless Hynd Design from any and all expenses, losses, liabilities, damages or third party claims resulting from "The Client's" breach or alleged breach of any client obligations set forth above.
